Money and property

Businesses, stock options and complex assets

When the balance sheet gets complicated, value first and negotiate second.

Some assets do not have a statement with a balance. They need a valuation before they can be divided.

A family business

A business started during marriage is usually marital property, even if one spouse runs it. A business valuator estimates its worth. The owner usually keeps the business and the other spouse receives other assets or payments over time.

Stock options and restricted stock

Options and restricted stock units granted during marriage may be partly marital, even if they vest later. Courts use time-based formulas to find the marital share. Record grant dates and vesting schedules.

Crypto and online accounts

Digital assets must be disclosed like any other property. Record wallet and exchange balances on a specific date.

When to bring in help

  • A certified divorce financial analyst can compare settlement options after tax.
  • A business valuator or forensic accountant can test reported income.
  • A lawyer should review any settlement involving a business or deferred compensation.
